These Terms of Service ("Terms") govern your access to and use of WorkAid Dunning ("the Service"), provided by WorkAid Solutions ("we", "us", or "our"). By registering for or using the Service, you agree to be bound by these Terms.
1. The Service
WorkAid Dunning is a payment recovery automation service that integrates with Stripe to send dunning email sequences when your customers' payments fail. The Service is provided as-is for business use only.
2. Eligibility
You must be at least 18 years old and have the legal authority to enter into contracts on behalf of any business you represent. The Service is intended for businesses, not individual consumers.
3. Account Registration
You must provide accurate and complete information when registering. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at info@workaidsolutions.com if you suspect unauthorised access.
4. Acceptable Use
You agree not to use the Service to:
- Send unsolicited or spam emails to any person
- Harass, threaten, or deceive any individual
- Violate any applicable law or regulation, including data protection laws
- Interfere with or disrupt the Service or its infrastructure
- Attempt to gain unauthorised access to any part of the Service
- Resell or sublicense the Service without our written permission
5. Stripe Integration
Use of the Service requires a valid Stripe account. You are responsible for your compliance with Stripe's own terms of service. We access your Stripe account data solely to provide the dunning functionality described in our documentation. We will never initiate charges on your behalf beyond the subscription fee for our Service.
6. Subscription & Payment
Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except where required by law. We reserve the right to change pricing with 30 days' written notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.
If your payment fails, we will attempt to notify you. Accounts with outstanding payments may be suspended after 14 days.
7. Subscriber Limits
Your plan includes a maximum number of active subscribers as described on the pricing page. Exceeding this limit may result in a request to upgrade. We will not immediately terminate service for exceeding limits but will provide reasonable notice.
8. Data & Privacy
Our collection and use of data is described in our Privacy Policy, which forms part of these Terms. You retain ownership of all data relating to your customers. You grant us a limited licence to process that data solely for the purpose of providing the Service.
You are responsible for ensuring you have a lawful basis to share your customers' data with us and that your privacy policy discloses the use of third-party payment recovery services.
9. Intellectual Property
The Service, including all software, design, and documentation, is owned by WorkAid Solutions and protected by copyright and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written consent.
10. Disclaimers
The Service is provided "as is" without warranty of any kind. We do not guarantee any specific recovery rate or revenue outcome. Dunning email deliverability depends on factors outside our control, including your customers' email providers.
11. Limitation of Liability
To the maximum extent permitted by law, WorkAid Solutions shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability to you in any calendar month shall not exceed the fees paid by you in that month.
12. Termination
Either party may terminate this agreement at any time. On termination, your access to the Service will cease at the end of your current billing period. You may request deletion of your data at any time by emailing info@workaidsolutions.com.
13. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you by email and by posting a notice in your dashboard at least 14 days before changes take effect. Continued use of the Service constitutes acceptance.
